2. Our DMCA Procedure

If you own any copyrightable content—such as photographs, short video clips ("Dashcam footage", "AI Scanned damage photos"), audio recordings, or written text—that has been uploaded to the Claim Filing AI platform via your MVA Case file(s) and appears unauthorized in our databases:

Written Notification: You must send a physical or email notice containing:

A description of the copyrighted work you claim has been infringed;

Identification of the URL, video clip ID, or dashboard location where that content is located on Claim Filing AI ("Claiming Link");

Your contact information (Address, Telephone Number); and

Statement: We require a written statement by you under penalty of perjury that:

You have a good faith belief that the disputed use of your MVA footage/image is not authorized; AND

The information provided in your notice above regarding your copyright ownership or claimed unauthorized usage (such as AI Scraped/Training purposes) is accurate and correct.

3. Removal & Replacement Process upon Counter-Notice

If a user whose image/video was removed from the platform submits us a written counter-notification stating under penalty of perjury they have permission to share that MVA data:

We will send them a copy within ten (10) business days;

Within twenty-one (21) calendar days after receipt, we will notify you again in writing via our designated contact ([email protected]) should the owner of said photo or video file elect to either dispute it ("file counter notice"); AND

If no such claim is filed within 5 business-days following notification by MA GRETCHEN (Designated Agent), we will reinstate that image/video content on our servers for use in MVA Case selling workflows unless you initiate a legal action against the user or us before its reinstatement occurs ("Takedown and Reinstatement Process").

4. Governing Law & Jurisdiction

Any disputes regarding this policy are governed by Hong Kong law as detailed in our Terms of Service, though it incorporates standard US DMCA safe harbor protections due to global internet accessibility of Claim Filing AI tools via our HK servers (+1 323 VoIP connection).
