1. Company Information

These Terms of Service ("Terms") are entered into by and between Scaling Brands Limited, a company incorporated in Hong Kong (Registration No: 78078867), with its registered address at FLAT B01, 2/F, KIN TAK FUNG IND BUILDING, 174 WAI YIP STREET, KWUN TONG HONG KONG ("Company", "we", "us", or "our"), and the user who accesses our Claim Filing AI platform or engages in MVA Case selling services ("User" or "you").

2. Acceptance of Terms

By registering on our platform, requesting a call, purchasing an MVA case filing service, or otherwise using our digital tools, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may withdraw from services within three (3) business days of initial contact.

3. Services Overview

We provide AI-driven automobile accident claim filing software ("Claim Filing AI"), MVA case aggregation/selling services, customer support telephony, and related digital tools. All services are primarily marketed, operated, and managed outside the United States mainland, though US-accessible communication lines may be provided for user convenience.

4. Claim Filing AI & MVA Case Transactions

You retain ownership of submitted accident data until case transfer or sale completion.

Pricing, fees, and payout structures are displayed at checkout/request unless otherwise agreed in writing.

Cases sold through our platform do not include legal representation unless explicitly selected as an add-on service.

Refunds for unused AI features may be processed on a prorated basis within 14 days of purchase.

5. Call Center & CAD Compliance (SB37/CAD)

Our telephony system utilizes prior express written consent, time-window scheduling, and frequency caps in accordance with international CAD standards.

Our primary phone line, +1 (323) 286-0754, is a US-accessible VoIP/toll routing number registered to Scaling Brands Limited in Hong Kong and is used exclusively for inbound calls. Users initiate the call by contacting us via our platform (claimfiling.ai), website, or marketing materials.

Because these are customer-initiated inbound calls for claim filing assistance, case status updates, or basic account support, they fall under the "Inbound" exemption in TCPA's Telemarketing law (Telephony Consumer Protection Act). No automated outbound dialers or frequency caps apply unless a paid subscription is actively solicited during the call.

Within sixty (60) seconds of connection, callers will be informed that their call may be recorded and/or routed to Hong Kong-based support agents operating outside mainland US jurisdiction. By calling +1 323 from within California or elsewhere in the US, users consent to this foreign routing and waive objections under local inbound telephony statutes.

You may opt out of future automated or live-agent calls by replying "STOP", clicking the unsubscribe link in our emails, or emailing [email protected]. Opt-outs take effect within 48 hours and do not apply to ongoing case workflows already initiated before your request.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict-of-law principles. Any disputes arising out of or related to these Terms, our services, or claimed violations shall be subject to the exclusive jurisdiction of the courts located in Kwun Tong District, Hong Kong. Users residing outside HK consent to this venue selection and waive any right to pursue claims under US state call center statutes (including but not limited to California) unless specifically opted into a US-routed service tier.

7. Limitation of Liability

To the maximum extent permitted by law, Scaling Brands Limited shall not be liable for indirect, incidental, consequential, or punitive damages arising from platform use, case filing delays, AI recommendations, or third-party insurer actions. Our total aggregate liability under these Terms shall not exceed the amount paid by you to us in the preceding twelve (12) months.

8. Modifications

We reserve the right to update these Terms at any time. Continued use of our platform after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email or a prominent banner on the Claim Filing AI dashboard.
