AI-Captured Media: Photos/video uploaded to the platform for damage assessment; voice recordings if users interact via VoIP or dictate claims notes through our app/website.

3. How We Use & Process Data (Including AI)

Data collected is processed by Claim Filing AI in accordance with PDPO Schedule 1 Principles:

Claim Structuring: To auto-populate MVA case forms and generate damage estimates based on uploaded media.

Case Selling/Transfer: Once a claim reaches a certain threshold, your data may be sold or transferred to third-party legal partners (e.g., personal injury law firms) for further processing of the case bundle.

Telecommunications Routing: Data from our +1 323 line is routed through VoIP gateways in Hong Kong for agent support and follow-up calls without requiring permanent storage on US servers unless necessary to close a call ticket.

4. Sharing Information

We do not rent or sell user names, email addresses, phone numbers, customer lists, IP Addresses, or mailing list subscribers with other companies for marketing purposes except as listed below:

Claim Partners: Insurance firms and auto-repair shops required to process the claim filed by our AI tools.

MVA Purchasers: Law firms that acquire specific accident case bundles generated through this platform (see Earning Statement).

5. California Privacy Rights & Opt-Out

To accommodate US users who access Claim Filing AI via VoIP or web:

You have the right to know what personal data is collected, how it is used, and who shares with third parties at any time by emailing our agent MA GRETCHEN.

California residents may request deletion of their information 30 days prior to a claim transfer/sale if applicable under PDPO standards as applied contractually in this Policy.

6. Data Retention & Storage

Your data remains on file until: (i) the accident case is fully processed and transferred; or (ii) twelve (12) months have passed since you first accessed our platform, whichever comes later. Upon deletion/expiration of use, all personally identifiable information (PII), including AI-processed images/video notes related to your MVA file, are permanently purged from active servers unless archived for legal audit purposes in HK courts.

7. Cookies & Tracking Technologies

We utilize session cookies and analytical tracking on claimfiling.ai solely to monitor app usage trends by geographic region (US vs Non-US) so we can allocate support resources appropriately within our Hong Kong operations centers without triggering US state-specific cookie compliance laws unless requested for payment gateway processing purposes.
